More than 1,000 entities providing crypto-asset services are currently registered in Poland in the register maintained by the Tax Administration Chamber in Katowice. From 1 July 2026, however, this registration will cease to be of key importance. The EU’s Markets in Crypto-Assets Regulation (MiCA), which harmonises the regulatory framework for the crypto-asset market across the European Union, will become fully applicable.

The problem? Poland still does not have national legislation implementing the MiCA framework. The Government bill, which would designate the Polish Financial Supervision Authority (KNF) as the competent supervisory authority, has already been vetoed three times by the President. Without a statutory designation of the supervisory authority, it is impossible to launch a domestic authorisation procedure for crypto-asset service providers. This means that, after 1 July, there will be no Polish cryptocurrency exchange operating lawfully in Poland in the full regulatory sense of the term.

As our expert points out, some Polish entities have already chosen to obtain authorisation in other EU Member States. Those companies will be able to continue operating lawfully by relying on the EU passporting mechanism for their services.
