These Regulations specify the rules for free use of the website www.jklaw.pl by individual Users and the type and scope of Services provided by the Law Firm, the conditions for the provision of these Services, the conditions for concluding contracts for the provision of Services and complaint procedures.
  3. The Regulations also constitute the regulations for the provision of electronic services referred to in Art. 8 of the Act of 18 July 2020. on the provision of services electronically.
  4. In connection with the administration of the Website www.jklaw.pl, the Law Firm may process Users’ personal data. Users’ Personal Data are processed by the Law Firm in compliance with the requirements of generally applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of April 27, 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation).
  5. The website of the Service is based on cookie technology. The principles of using “cookies” by the Administrator are included in the Privacy Policy available at www.jklaw.pl .

  6. Services – services provided by JKLAW electronically to the User, i.e. access service to the Website, newsletter service.
  7. User – a natural person who uses the Website or who uses one or more services or functionalities described in the Regulations or whose personal data is processed by JKLAW.
  8. Newsletter – a service provided electronically by the Website Owner to the User, meaning a set of information sent by the Website Owner to the e-mail address provided by the User, containing information, promotional and/or advertising content of the Website Owner and/or other persons and/or goods and/or services offered by the Service Provider and/or other persons, in particular commercial information;
  9. Administrator – the administrator of users’ personal data is the Law Firm. In matters relating to your personal data, you can contact the Administrator at the above-mentioned address. the Administrator’s postal address or electronic address: office@jklaw.pl .
  10. Consumer – a natural person concluding a legal transaction with an entrepreneur that is not directly related to his or her business or professional activity.
  11. Entrepreneur – a natural person, a legal person or an organizational unit that is not a legal person, which is granted legal capacity by special provisions, conducting business or professional activity on its own behalf.
  12. Entrepreneur with consumer rights – a natural person using the Website, however, the use of the Website is not of a professional nature for him, resulting in particular from the subject of business activity made available on the basis of the provisions on the Central Registration and Information on Business.

General terms of use of the website

  1. Use of the Website is voluntary and free of charge for all Users.
  2. The User may resign from using the Website at any time.
  3. The contract for the provision of access to the Website is concluded on the terms specified in the Regulations, for an indefinite period of time, when the User successfully calls up the URL of the Website in the browser window of the User’s device or when the User uses the redirection leading to the Website (i.e. when entering the Website). ); in this case, the agreement for the provision of the Service of access to the Website is terminated when the User leaves the Website.
  4. The User may terminate any contract for the provision of Electronic Services at any time, without giving a reason, with immediate effect.
  5. The condition for using the Services by the User with the Website Owner is that the User read these Regulations and accept them without any changes or reservations.
  6. The website is informative and serves to present the Law Firm’s offers and make its promotional materials available.
  7. The Website User understands that the content posted by the Law Firm on the Website is of a general (informative) nature, is not of an individual nature and cannot be considered as providing any consulting services.
  8. While using the Website, the User is prohibited from providing or transmitting illegal content. The User is obliged to use the Website in accordance with the principles of social coexistence and intellectual property law.

Technical requirements

  1. The use of the Website is possible provided that the User meets the minimum technical requirements, i.e.:
    a) having a computer or mobile device equipped with an operating system;
    b) the computer or mobile device will have access to the Internet;
    c) the computer or mobile device will have a properly installed and configured web browser (Mozilla Firefox, Google Chrome, Internet Explorer, Safari);
    d) having an active e-mail account.
    2. The Law Firm does not guarantee and is not responsible for the fact that each of the above-mentioned combination of technical conditions will always enable the use of the Website.

Newsletter

  1. The Law Firm provides a free electronic service in the form of a legal newsletter service, which involves sending marketing and expert information to Users, as well as information about upcoming events.
  2. The contract for the provision of the Newsletter service is concluded by completing the Newsletter subscription form.
  3. Subscribing to the Newsletter requires providing an e-mail address and confirming the subscription by pressing the “Subscribe” button. The user is obliged to provide correct data in the form.
  4. Użytkownik może w każdym momencie zrezygnować z usługi Newslettera poprzez:
    a) przesłanie rezygnacji za pomocą wiadomości e-mail na adres: office@jklaw.pl
    b) przesłanie rezygnacji pocztą tradycyjną na adres pocztowy: Kancelaria Jabłoński Koźmiński i Wspólnicy Adwokaci i Radcowie Prawni sp.k. z siedzibą pod adresem: ul. ul. Stanisława Moniuszki 1A, 11 piętro, 00-014 Warszawa;
    c) w formie elektronicznej za pośrednictwem aktywnego linku każdorazowo umieszczonego w stopce każdej wiadomości wysyłanej w ramach usługi Newsletter oznaczony jako „Rezygnuję z usługi Newsletter”.

Complaints

  1. Użytkownik może kierować wszelkie zastrzeżenia w formie reklamacji w sprawach związanych z korzystaniem usług określonych w niniejszym Regulaminie na adres mailowy Kancelarii: office@jklaw.pl lub pocztą tradycyjną na adres pocztowy: Kancelaria Jabłoński Koźmiński i Wspólnicy Adwokaci i Radcowie Prawni sp.k. z siedzibą pod adresem: ul. ul. Stanisława Moniuszki 1A, 11 piętro, 00-014 Warszawa.
  2. All complaints related to the provision of electronic services will be considered within no more than 30 calendar days from the date of receipt of the complaint.
  3. The Law Firm responds to the complaint to the e-mail address indicated by the User in the complaint or, in the case of submitting a complaint via traditional mail, to the postal address indicated by the User.
  4. The User has the right to submit a complaint in order to resolve a possible dispute with JKLAW via the EU online platform (ODR platform) at: https://ec.europa.eu/consumers/odr.

Information related to the principles of personal data processing, including information on the User’s rights related to the processing of personal data, can be found in the Privacy Policy at: www.jklaw.pl.

Changes to the regulations

  1. The Law Firm is entitled to unilaterally change these Regulations to the extent that they have not been individually agreed with the User for justified reasons. In particular, the following are considered to be justified reasons:
    a) a change in the provisions of law generally applicable in the Republic of Poland to the extent that such a change in the provisions modifies the content of the Regulations or imposes on the Website Owner an obligation to modify the Regulations in a specific manner;
    b) issuance of decisions or acts of a similar nature by public administration bodies, as well as guidelines in which these documents modify the content of the Regulations or impose on the Law Firm an obligation to modify the Regulations in a specific manner;
    c) the Website Owner introduces new functionalities of the Website or modifies their existing scope;
    d) introduction of new or modification of existing IT systems by the Website Owner;
    e) the emergence of court or administrative decisions which show that contractual provisions analogous to those used by the Website Owner may be contrary to generally applicable law, in particular consumer protection law from the point of view of an average consumer or entrepreneur to whom the provisions apply. Act on Consumer Rights – in this case, the proposed amendment to the Regulations is permitted only for his benefit.
  2. The amendment to the Regulations does not apply to contracts concluded before the date of entry into force of the amendment to the Regulations. The provisions of the Regulations in force on the date of expressing the User’s will to conclude the contract shall apply to contracts concluded before the date of entry into force of the amendment to the Regulations.
  3. The Website Owner will inform Users by posting a message on the Website about changes to the Regulations, containing: the content of the planned change, the date of entry into force of the changes to the Regulations and the uniform content of the Regulations after the changes.
  4. Changes made to the Regulations come into force on the date given along with the information about the change. Changes made to the Regulations are binding on the User provided that he or she has been properly notified of the changes and has not terminated the concluded Agreement within 14 days from the date of receipt of the notification of the change.

Final Provisions

  1. These Regulations are valid from the date of their publication on the JKLAW Website.
  2. The Regulations are made available free of charge via the Website.
  3. The use of the Website is subject to Polish law and the jurisdiction of Polish courts. In matters not regulated in the Regulations, the relevant provisions of law generally applicable in the Republic of Poland will apply.
  4. None of the provisions of the Regulations limit the Consumer’s or Entrepreneur’s consumer rights under the provisions of law in force in the territory of the Republic of Poland.
  5. Any disputes regarding the Website or the Services provided by JKLAW will be subject to the exclusive jurisdiction of the court having jurisdiction over the registered office of the Website Owner.
