  2. These Terms and Conditions set out the rules for free use by individual users of the service named www.jklaw.pl as well as the type and scope of the Services provided by the Law Firm, the terms and conditions for the provision of these Services, the terms and conditions for the conclusion of agreements on the provision of the Services and the complaint procedures.
  3. Terms and Conditions also constitute the regulations for the provision of services by electronic means, as referred to in Article 8 of the Act of 18 July 2020 on the provision of services by electronic means.
  4. With regard to the administration of the www.jklaw.pl Law Firm Website, the Law Firm may process Users’ Personal Data. Users Personal Data shall be processed by the Law Firm in compliance with the requirements of generally applicable law, in particular Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons in relation to the processing of personal data and on the free movement of such data and repealing Directive 95/46/EC (General Data Protection Regulation).
  5. The Service website operates on the basis of “cookies” technology. The rules governing the use of cookies by the Controller are contained in the Privacy Policy available at the following web address www.jklaw.pl.

  3. Owner of the Service – the Law Firm.

  10. Consumer – a natural person making a legal transaction with an entrepreneur that is not directly related to his/her economic or professional activity.
  11. Entrepreneur – a natural person, a legal person or an organizational unit that is not a legal person, to which special regulations grant legal capacity, conducting business or professional activities on its own behalf.
  12. Entrepreneur on the rights of a consumer – a natural person using the Service, however, the use of the Service is not of a professional nature for him/her, arising in particular from the subject of the performed business activity made available on the basis of the provisions on the Central Register and Information on Business Activity.

General terms and conditions of service

  1. Use of the Website is voluntary and free of charge for all Users.
  2. The User may resign from using the Website at any time.
  3. The contract for the provision of access to the Website is concluded on the terms specified in the Regulations, for an indefinite period of time, when the User successfully calls up the URL of the Website in the browser window of the User’s device or when the User uses the redirection leading to the Website (i.e. when entering the Website). ); in this case, the agreement for the provision of the Service of access to the Website is terminated when the User leaves the Website.
  4. The User may terminate any contract for the provision of Electronic Services at any time, without giving a reason, with immediate effect.
  5. The condition for using the Services by the User with the Website Owner is that the User read these Regulations and accept them without any changes or reservations.
  6. The website is informative and serves to present the Law Firm’s offers and make its promotional materials available.
  7. The Website User understands that the content posted by the Law Firm on the Website is of a general (informative) nature, is not of an individual nature and cannot be considered as providing any consulting services.
  8. While using the Website, the User is prohibited from providing or transmitting illegal content. The User is obliged to use the Website in accordance with the principles of social coexistence and intellectual property law.

Technical requirements

  1. In order to use the Website, the User should comply with the following requirements:
    a) your computer or mobile device should have an operating system;
    b) your computer or mobile device must have access to the Internet;
    c) the computer or mobile device will have a correctly installed and configured web browser (Mozilla Firefox, Google Chrome, Internet Explorer, Safari);
    d) have an active e-mail account.
    2. The law firm does not guarantee and is not responsible for the fact that each of the above-mentioned combinations of technical conditions will always make it possible to use the Service.

Newsletter

  1. The law firm provides free of charge an electronic service in the form of a legal newsletter which consists of sending marketing and expert information as well as information about upcoming events to the users.
  2. The agreement for the Newsletter service is concluded by filling in the Newsletter subscription form.
  3. Subscription to the Newsletter requires an e-mail address and confirmation of the subscription by pressing the “Subscribe” button. The user is obliged to provide correct data in the form.
  4. The User may unsubscribe from the Newsletter service at any time by:
    a) sending resignation by e-mail to: office@jklaw.pl

    c) in electronic form via an active link each time placed in the footer of each message sent within the Newsletter service marked as “unsubscribe”.

Complaint handling procedure

  1. The User may send all objections in the form of complaints on matters related to the use of services specified in these Terms and Conditions to the Law Firm’s e-mail address: office@jklaw.pl or by post to the mail address: Kancelaria JabÅ‚oÅ„ski KoźmiÅ„ski i Wspólnicy Adwokaci i Radcowie Prawni Spółka Komandytowo-Akcyjna with its registered office at: ul. LondyÅ„ska 4, 03-921 Warsaw.
  2. All complaints relating to the provision of electronic services will be handled within no later than 30 calendar days of receipt of the complaint.
  3. The Law Firm shall send its response to the complaint to the e-mail address indicated by the User in the complaint or, in the case of a complaint submitted by post, to the postal address indicated by the User.
  4. The user has the right to submit a complaint in order to resolve a possible dispute with JKLAW via the EU online platform (ODR platform) at: https://ec.europa.eu/consumers/odr.

Amendments to terms and conditions

  1. The law firm shall be entitled to unilaterally amend these Terms and Conditions to the extent that they have not been individually agreed with the User for good cause. As a justified reason is considered in particular:
    a) a change in the generally applicable laws in the Republic of Poland to the extent that such a change in the laws modifies the content of the Regulations or imposes an obligation on the Service Owner to modify the Regulations in a specific manner;
    b) issuance by public administration authorities of decisions or acts of an analogous nature, as well as guidelines to the extent that such documents modify the content of the Regulations or impose an obligation on the Service Owner to modify the Regulations in a specific manner;
    c) introduction by the Service Owner of new functionalities of the Website or modification of their current scope;
    d) introduction by the Service Owner of new or modification of existing IT systems;
    e) the emergence of judicial or administrative case law, from which it follows that contractual provisions analogous to those used by the Service Owner may be in conflict with universally applicable law, including, in particular, consumer protection law from the point of view of the average consumer or entrepreneur on the rights of a consumer – in which case the proposed modification of the Terms and Conditions is admissible only in his favor.
  2. The change of the Terms and Conditions does not apply to contracts concluded before the effective date of the change of the Terms and Conditions. Contracts concluded before the effective date of an amendment to the Terms and Conditions shall be governed by the provisions of the Terms and Conditions in force on the date of the User’s willingness to conclude the contract.
  3. The Service Owner will inform Users by posting a message on the Service about amendments to the Terms and Conditions, including: the content of the planned amendment, the effective date of the amendment to the Terms and Conditions and the consolidated content of the Terms and Conditions after the amendments.
  4. Changes made to the Terms and Conditions shall come into force on the date specified with the information about the change. Changes made to the Terms and Conditions shall be binding for the User provided that he/she has been correctly notified of the changes and has not terminated the concluded Agreement within 14 days from the date of receipt of the notification of the change.

Final Provisions

  1. These Terms & Conditions shall become effective as of the date of inclusion on the JKLAW Service.
  2. Access to the Terms & Conditions shall be provided free of charge via the Website.
  3. The use of the Service is subject to Polish law and the jurisdiction of Polish courts. In matters not regulated herein, the provisions of Polish law shall apply.
  4. None of the provisions of these Terms and Conditions restricts the rights of the Consumer or Entrepreneur – on the rights of the Consumer, which he/she is entitled to on the basis of the legal provisions in force in the territory of the Republic of Poland.
  5. Any dispute relating to the Website or the Services provided by JKLAW shall be subject to the exclusive jurisdiction of the court having jurisdiction over the location of the Service Owner.
