About the practice

The Law Firm’s team has unique experience in the field of regulatory consultancy, especially legislative and constitutional advice, bringing together lawyers specializing in drafting normative acts and developing comprehensive postulates de lege ferenda and the concept of amendments to existing regulations, the preparation of cross-sectional legislative expertise, the assessment of compliance from the constitutional point of view and the requirements of EU law, as well as the assessment of the effects of regulations.

The Regulatory Advisory and Compliance practice also includes support in the design and evaluation of local and internal law, as well as initiating review proceedings of normative acts before the Constitutional Tribunal, administrative courts and European Union bodies.

The Law Firm also has extensive experience in initiating proceedings aimed at obtaining liability for damages for legislative illegality.

  • Preparation of expert opinions as part of the legislative process, as well as drafts of normative acts;
  • Preparation of legal opinions on compliance with the Constitution and European Union law;
  • Preparation of constitutional complaints, draft applications to the Constitutional Tribunal and extraordinary complaints;
  • Monitoring of legislation and analysis of the state of regulations in a specific area in order to develop alternative solutions;
  • Legal support at the stage of the consultation and opinion process;
  • Support in ensuring compliance with banking law, AML, GDPR, MiFID II, CRD IV/CRR, PSD II, IDD, EMIR, PRIIPs, eMoney;
  • Advising on the day-to-day functioning of the entity provided to the Management Board, Supervisory Board, Audit Committee and other bodies;
  • Representation in pursuing actions for damages due to legislative illegality and other cases of unlawful exercise of public authority;
  • Training activities in the field of law-making procedures, legislative technique, regulatory impact assessment;
  • Risk identification, finding appropriate legal instruments to be used to mitigate risk;
  • Preparation, implementation and application of the Compliance procedure.
