Education of lawyers and the future of arbitration – a petition by Łukasz Wydra, PhD to the Ministry of Science and Higher Education

A few months ago, Łukasz Wydra, PhD, the Leader of the Arbitration Practice at Jabłoński Koźmiński & Partners Law Firm, submitted a petition to the Ministry of Science and Higher Education for the information of the Ministry of Justice. The petition emphasizes the need to include alternative dispute resolution methods (ADR), including mediation and arbitration, in the curricula of law faculties. This initiative aims to promote arbitration as an effective dispute resolution tool that could significantly relieve the Polish courts.


In Poland, arbitration is still underused despite its speed, confidentiality, and stability of decisions. The average time of arbitration proceedings is about a year, a significant advantage compared to the several months one often must wait for a decision in state courts. However, the key barrier is the lack of awareness and education among lawyers and entrepreneurs in the ADR field.

We are pleased to inform you that at the beginning of December this year, the Minister of Science and Higher Education responded to the petition of Łukasz Wydra, PhD. In his response, the Minister of Science emphasized the autonomy of the university’s curriculum, at the same time informing that he had sent a letter to the conferences of rectors, such as CRASP (The Conference of Rectors of Academic Schools in Poland), with a request to present this issue to universities offering law studies. The aim is to analyze the possibilities of deepening the study programs with issues related to ADR, particularly arbitration and mediation.

This is a necessary step towards popularizing alternative dispute resolution methods in Poland, which can significantly relieve state courts and speed up economic procedures. We believe that legal education enriched with practical knowledge in the field of ADR will contribute to the increase in the efficiency of the justice system, preparing graduates better for the challenges of the legal market.
