BANK.pl: A summary of Challenges of Banking 2024 Conference

The BANK.pl portal published a summary of the “Banking Challenges” conference organized by the Polish Bank Association and Kozminski University on November 6 this year, entitled “Free credit, free housing”.

The event was an excellent opportunity for representatives of the academic world and practitioners to exchange views and analyze the challenges faced by the banking sector.

One of the points in the conference’s program was Panel II, which focused on the problem of the stability of banking contracts. This was a discussion in which dr hab. Krzysztof Koźmiński, prof. UW – Managing Partner of the Jabłoński Koźmiński & Partners Law Firm took part in.

During his speech, our expert emphasized that:

  • such a large number of cases with which the courts are burdened, in practice, results in a violation of the fundamental right to a fair trial;
  • in Swiss Franc loan cases, it is becoming a common practice to thoughtlessly copy the content of previous judgments into new judgments, which sometimes even leads to errors in determining the identity of the plaintiff;
  • The CJEU, in its judgments, often goes beyond the typical role of a court, in fact influencing the creation of new legal norms and imposing new standards of adjudication for contracts concluded even a dozen or so years ago.
