This Privacy Policy sets out the rules for the processing and protection of personal data by Jabłoński Koźmiński & Partners Advocates and Legal Advisers Spółka Komandytowo-Akcyjna with its registered office in Warsaw in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016. on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR“) and other applicable data protection legislation.
The privacy policy also contains a description of the basic principles relating to the use of cookies on the Website.

Purposes and legal basis for data processing

Depending on the purpose of the processing, we may collect the following personal data:

  • As part of the use of our website:
    Your IP address, the type of device you use to access the website, the type of operating system, processor, RAM, browser type, language, domain name, location data (country and region of access), data about the content visited on our website (general, not requiring analysis of specific behaviour or profiling),
    cookies.
  • When you subscribe to our newsletter or mailing list:
    e-mail address, date of registration and unsubscription, history of sent mailings or newsletter reception.
  • As part of the contact for inquiries sent by e-mail, telephone or traditional mail:
    Your email address, phone number, first name, last name or other details provided by you in a given situation.

Legal bases

Your personal data may be processed on the following legal grounds:

  • Use of our website and the online services available on it:
    Article 6(a) 1 lit. f) GDPR – legitimate interest, which is to ensure the functionality of our website, to fix errors and to analyse visitor statistics.
  • subscribing to our Newsletter or mailing list (informing about the activities of the Law Firm, important events, legislative changes and rulings in the field of law):
    in the case of voluntary consent to the processing of data pursuant to Article Article 6(1) 1 lit. a) GDPR.
  • Contact for inquiries by e-mail, telephone or traditional mail:
    a) in order to respond to your inquiry – the legal basis is the legitimate interest of the Controller, which is to handle correspondence and analyze received inquiries (Article 6(1)(f) of the GDPR) or to take action at your request before concluding a contract (Article 6(1)(c) of the GDPR);
    b) in order to conclude and monitor the contract for the provision of legal services concluded with the Law Firm, to cooperate in the performance of the contract – the legal basis is the necessity of processing for the performance of the contract (Article 6(1)(b) of the GDPR);
    c) for the purpose of possible determination and pursuit of claims or defence against claims – the legal basis for the processing is the legitimate interest of the Controller (Article 6(1)(f) of the GDPR), consisting in the protection of their rights.

Your rights

In connection with our processing of your data, you have the right to:
a) access (you have the right to obtain information about the processing to which your data is subject);
b) rectification (you can request us to correct or complete your data if there has been a mistake, update or lack of information);
c) erasure of your data (you can request us to delete your data if this is possible in accordance with the GDPR);
d) data portability (you may request the portability of your data for yourself or any third party in the case of certain data processed by automated means, on the basis of your consent or on the basis of a contract concluded with us);
e) restriction of data processing (in some cases, you can request the restriction or cessation of the processing of your data);
f) object (you may object to the processing of your data for reasons related to your particular situation in cases where the processing is carried out on the basis of Article 6(1)(f) of the GDPR, when the processing is necessary for the purposes of the legitimate interests pursued by the controller or by a third party);
g) withdraw your consent to the processing of your data (this is possible at any time and does not affect the lawfulness of the processing that was carried out before the consent was given).

Recipients of the data

The recipients of personal data may be other entities in cases where it is necessary and to the extent justified by the appropriate legal basis and purpose of the processing of personal data, including on the basis of the processing of personal data on our behalf.
The categories of recipients identified by the Law Firm are entities cooperating with the Law Firm in the scope of services provided to the Law Firm and supporting the current business processes of the Law Firm: IT service providers, hosting companies, couriers, postal operators, banks and payment operators.
The Administrator reserves the right to disclose selected information concerning the User to competent authorities or third parties who submit a request for such information, based on an appropriate legal basis and in accordance with the provisions of applicable law.
The Law Firm’s partners are located in the countries of the European Economic Area (EEA).
In a situation where the Controller were to transfer personal data outside the EEA, an adequate level of protection will be ensured, consisting of:
(a) verify that partners located outside the EEA ensure an adequate level of protection of personal data;
b) cooperation with entities processing Personal Data in countries for which an appropriate decision of the European Commission has been issued regarding the adequacy of Personal Data protection;
(c) the use of standard contractual clauses issued by the European Commission.

Duration of data storage

We will store your personal data for the period necessary to fulfil our obligations, including tax obligations and the purposes set out above in this Privacy Policy, until the claims are time-barred, you object or you withdraw your consent. As soon as the data we collect is no longer needed for these reasons, we will take all reasonable steps to ensure that it is securely deleted or anonymized.

Information about automated decision-making, including profiling

Personal data will not be processed in a purely automated manner (including in the form of profiling) that may produce legal effects on data subjects or similarly significantly affect their situation.
