Overbooking in aviation – what does the law have to say about it? Experts from our Law Firm are the authors of a chapter in a monograph

We are thrilled to announce that lawyers from our firm – Magdalena Tyka-Jabłońska, attorney-at-law and Partner, along with Michał Walak, Paralegal – have authored the chapter titled “Overbooking in civil aviation – selected legal issues”, featured in the latest monograph edited by Prof. Anna Konert and Dr. Agnieszka Fortońska: A. Konert, A. Fortońska (red.), Prawo lotnicze z perspektywy bezpieczeństwa oraz zrównoważonego rozwoju, Warszawa 2025, DOI 10.26399/978-83-66723-83-2.

The topic of overbooking—seemingly purely operational—is a space of complex relations between transport law, passengers’ interests, and the limits of the carrier’s permissible economic risk.

The authors analyze, among others:

  • the origins and legal status of the overbooking practice,
  • the obligations of carriers and the rights of passengers,
  • the conflict between EU and international standards,
  • procedural issues concerning pursuing additional claims for overbooking under national law.
