What was the Court’s ruling?

  • Having a boarding pass allows a passenger to claim compensation for a delayed flight.
  • Payment for the trip by a third party does not deprive the passenger of the status of being “entitled” to claims, even if the tour operator ultimately settles the amount due for the ticket to the carrier.

This is an important position of the CJEU that strengthens passengers’ standing in disputes with carriers and clears up practical doubts regarding the principles of pursuing claims.
