We encourage you to read the article “Gender parity in the largest companies. Lawyers assessed the new obligation,” [PL: “Parytet płci w największych spółkach. Prawnicy ocenili nowy obowiązek”] published in Dziennik Rzeczpospolita Magazine as part of the Lawyers’ Panel series.

What do the new regulations provide?

From July 2026, listed companies with more than 250 employees will be required to introduce a policy ensuring a minimum 33 percent share of the underrepresented sex on management and supervisory boards. The Polish Financial Supervision Authority will be able to impose financial penalties of up to 10 percent of annual revenue if they fail to meet these requirements.

The opinion of our expert

In our expert’s opinion (a permanent participant of the Lawyers’ Panel), dr hab. Krzysztof Koźmiński, Prof. UW – Managing Partner of Jabłoński Koźmiński & Partners Law Firm:

“The proposed solution is extreme, disproportionate, even drastic. The originator of such regulations should be called an ideologist and a social engineer, not a lawyer“.

29% of experts believe gender parity should also apply to other companies. In turn, 38% of lawyers do not support financial penalties in the proposed form, considering them ineffective and excessive.
