We are pleased to announce that the latest publication by the Managing Partner of JabĆoĆski KoĆșmiĆski & Partners Law Firm, Dr. MichaĆ JabĆoĆski, and co-authored by MichaĆ Walak, entitled  âThe legal architecture of international investment security in the light of geopolitical challenges“, was published in the monograph entitled “BezpieczeĆstwo miÄdzynarodowe w perspektywie geopolitycznejâ [ENG: âInternational security in a geopolitical perspectiveâ] (ed. W. ĆmiaĆek, Ć. Kominek, FNCE Publishing House, PoznaĆ 2025).
The publication offers a comprehensive analysis of the challenges faced by international investment protection mechanisms (including the ISDS system) in a time of heightened geopolitical tensions and economic sanctions.
The authors discuss, among others:
- the impact of the CJEU judgment in the Achmea case on intra-EU BITs,
- crisis of confidence in ISDS in the context of TTIP,
- controversy surrounding the termination of the Energy Charter Treaty,
- development of the Multilateral Investment Court concept and solutions implemented in the CETA agreement,
- the effects of the war in Ukraine on the protection of foreign investments â including Russian retaliatory measures and the problem of enforceability of arbitration awards.
