We are pleased to announce that the latest publication by the Managing Partner of JabƂoƄski KoĆșmiƄski & Partners Law Firm, Dr. MichaƂ JabƂoƄski, and co-authored by MichaƂ Walak, entitled  “The legal architecture of international investment security in the light of geopolitical challenges“, was published in the monograph entitled “BezpieczeƄstwo międzynarodowe w perspektywie geopolitycznej” [ENG: “International security in a geopolitical perspective”] (ed. W. ÚmiaƂek, Ɓ. Kominek, FNCE Publishing House, PoznaƄ 2025).

The publication offers a comprehensive analysis of the challenges faced by international investment protection mechanisms (including the ISDS system) in a time of heightened geopolitical tensions and economic sanctions.

The authors discuss, among others:

  • the impact of the CJEU judgment in the Achmea case on intra-EU BITs,
  • crisis of confidence in ISDS in the context of TTIP,
  • controversy surrounding the termination of the Energy Charter Treaty,
  • development of the Multilateral Investment Court concept and solutions implemented in the CETA agreement,
  • the effects of the war in Ukraine on the protection of foreign investments – including Russian retaliatory measures and the problem of enforceability of arbitration awards.

The chapter aims to address how to restore the effectiveness and legitimacy of the investment protection system in light of new, challenging international realities.
