The sprawdzamto.pl portal has published an interview with Professor Krzysztof Koźmiński, Managing Partner at Jabłoński Koźmiński & Partners and Professor at the University of Warsaw, focusing on the legal liability of Big Tech companies for content published in the digital environment.

The issue of Big Tech liability is not new to us. In February this year, experts from Jabłoński Koźmiński & Partners – Dr Michał Jabłoński, Professor Krzysztof Koźmiński, Dr Grzegorz Keler, Jan Rudnicki and Jan Czarnocki – prepared a report for the Warsaw Institute of Banking entitled “The Problem of Unauthorised Transactions in the Context of Big Tech Liability for Advertising”. The report examined the role of global online platforms in facilitating financial fraud and the legal mechanisms that could be used to counter such practices.

The internet is no longer a pluralistic forum for the exchange of ideas. It has become a space dominated by entities whose power exceeds that of many states, backed by vast legal budgets, headquartered outside the European Union and capable of factoring penalties for legal infringements into their business models from the outset.

  • Is a platform that receives payment for publishing a fraudulent advertisement merely a neutral intermediary – or does it share responsibility for the wrongdoing?
  • Where should the line be drawn between purely technical intermediation and profiting from unlawful content?
  • Could a compensation fund financed by Big Tech companies provide an alternative to costly and protracted court proceedings?
