In the face of successive amendments to the Code of Civil Procedure, the key to litigation success lies not only in a thorough knowledge of the law but, fundamentally, in the ability to implement these regulations effectively within complex disputes.
On 15–16 June 2026, MMC Polska will host an online workshop titled: “Civil procedure on the threshold of change – practical aspects and litigation challenges.”
During the event, Damian Michalski, Solicitor (radca prawny) and Counsel at Jabłoński Koźmiński & Partners, will serve as an expert speaker, leading two key panels dedicated to the strategic aspects of modern civil litigation. Our expert will provide a detailed analysis of the following areas:
Digital evidence in civil proceedings – admissibility, preservation, and analysis
- Standards for the admissibility of digital evidence in light of current case law and amendments to the Code of Civil Procedure.
- Evidence derived from the Internet, electronic correspondence, messaging apps, and IT systems – technical and procedural aspects of collection.
- Preservation and recording of evidentiary material prior to the commencement of litigation.
- Criteria for the judicial assessment of the credibility of digital evidence and associated practical risks.
- The role of expert witnesses and IT tools in analysing evidentiary material.
Concentration of procedural material and case management
- Principles of the concentration of procedural material (koncentracja materiału procesowego) under current regulations.
- Strategic litigation planning at the stage of drafting the statement of claim and the defence.
- The preparatory hearing (posiedzenie przygotowawcze) – objectives, procedure, and significance for the further course of litigation.
- The hearing plan as an instrument for organising evidentiary proceedings and ensuring the timeliness of procedural acts.
- Consequences of the belated submission of assertions and evidence, and the limits on the admissibility of their late filing.
- Divergences in judicial practice regarding the application of the concentration principles.
Participation in this workshop offers a valuable opportunity to update your knowledge on the real-world impact of amendments to the Code of Civil Procedure on case strategy. The discussion of specific case studies will enable participants to manage proceedings more efficiently, utilise available legal remedies more effectively, and mitigate litigation risks in highly complex disputes.
